Making Money Online With



The Middle East’s largest online auction and buying site has decided auctions are so last decade.


From the beginning of 2011 sellers won’t get the option to sell their products in an auction. It’s fixed price, or none at all.


The decision comes as a shock to many as Souq.com, which opened its doors to the public in 2005 and has since launched in 5 countries in the region, has always been portrayed as the eBay of the Middle East. At least in terms of online auctions, not anymore.


“We (and most of our sellers) want to offer the best online shopping experience to users in the region, and this is one step along the way to support this goal.” said CEO and Founder of Souq.com Ronaldo Mouchawar in an email about the recent shift.


This change, as most in life, will have its supporters and detractors. The good thing is, it looks like a only slim minority might end up annoyed.


To illustrate the above, lets say you’re a painter and you work from home during your spare time. I’m one of those who believe art has no price, but since it’s good to have paint to create priceless masterpieces, putting the occasional price tag on your work isn’t entirely evil. The only problem with that is how do you put a price tag on art in the first place? Van Gough considered giving money for art is as important as being an artist yourself. That’s where auctions come in strong.


By putting up a painting to sell through an auction, the seller allows the highest bidder to give her as much it takes to win the auction, or otherwise ask to ‘Buy Now’ according to a price the seller sets. Will this shift be good for those who realistically don’t know how much their work is worth? I would say no.


On the flip-side regional retail stores tend to invest large amounts of money to put their products online on their own, and usually fail miserably. Many factors come into play, but the most obvious are a large user base and an easy to use website to buy from.


This encouraged Souq.com to build a platform for merchants and retail stores to offer their products on Souq through fixed prices (almost all the time), and through Souq Stores which are customizable online outlets for retailers such as UAE’s 

Even the long fawning UK press is now saying what any startup who has tangled with the music industry has said all along: Spotify will not be able to launch its free any-song-you-want-to-hear-the-second-you-want-to-hear-it service in the US. The Telegraph is reporting that at the last minute the labels demanded too much upfront cash, killing a hard negotiated potential deal.


This is sad, but not a surprise. Despite all the reasons consumers would love it and labels should be empowering a rival for iTunes, the labels are in defensive mode and have never been rational when it comes to these things. My issues with how Spotify has handled this aside, I actually didn’t want to be right on this one. It’s a sad day for users.


But this will be the interesting thing to watch: Does Spotify just roll these we’re-definitely-launching-in-the-US assurances forward to 2011, the way the company has the last two years or does it pivot, and focus on building a profitable site for Europe and other less guarded pockets of the emerging world? In the Telegraph link above an unnamed source says the year of brutal negotiations has forced Spotify to “stop and think about whether it can afford the move to the US and indeed whether it is worth it,” while the article quotes a Spotify spokesman as saying the negotiations are “on-going.” Oh, Spotify.


Here’s my advice: Pivot. Spotify has spent two years, and undoubtedly plenty of money and focus, fighting what was always a Don Quixote like battle to make the US labels listen to reason. This is the same industry who sued their users. It was a valiant effort, but it didn’t work. We can argue why they should back Spotify all day long, but the last two years has proven that they are just not going to listen without Spotify having to make some major concessions.


I think Spotify should walk instead of making those concessions. No matter how hot of a startup you are, money and time are exhaustible commodities. Spotify should start directing them at challenges elsewhere until there is enough of a sea-change in the US music market that labels see reason. Giving into the labels’ demands isn’t the answer. Instead, Spotify should retreat, build in other countries, perfect its model, get to profitability, and then come back to this market when the labels are weaker and Spotify is stronger, boldly proving cynics like me flat wrong. Use your international headquarters as an advantage, not a liability.


Spotify board member Klaus Hommels told me in an interview late last year that he believed Spotify may be the venture industry’s last-ditch effort to build an online music company. (Other than Pandora, of course, the online music company with nine-lives that finally won the right to exist.) He told the labels in negotiations that if they opted instead to drain Spotify’s venture cash and leave it for dead the way they have to so many others, they may never get another hot upstart to back. And that would resign them to an Apple dominated world.


He may be right. So why not play the long game, instead of the short one?

Martin,



While I respect your efforts to warn would-be entrepreneurs about illegal schemes, your observations regarding multilevel marketing (MLM) are ignorant and unjustified. Please understand that I am not using the term "ignorant" derogatorily, but rather to describe your commentary as being ignore-ant of readily available historical, mathematical, and legal information about this industry and profession.



First of all, as a successful distributor, consultant, advocate, and court certified expert in the field of multilevel marketing, I am offended by your reference to my profession as a pyramid scheme only by a "matter of degree". There are well over 1,000 such companies in the U.S. alone, which is one of 80+ countries where it's recognized as a legal and legitimate form of business. You assert that they "all" sound like "get rich quick schemes" to you. How many of these several hundred MLM programs have you researched and evaluated? This business model has existed for 75 years, and includes not only Mary Kay and Lia Sophia, but also Shaklee, Avon, Discovery Toys, Watkins, Tupperware, Pampered Chef (owned by Warren Buffet) and many other good corporate citizens (over 20 of which are publicly traded). Your characterization of this profession does a grave disservice to the 30 million world-wide distributors, 20,000+ employees, hundreds of vendors, and thousands of investors associated with this industry.



You state "…the essence of an entrepreneur is creating something new and innovative, whereas an MLM is a traditional formula on an existing product…". And a typical Starbucks or McDonald's franchise is not? But this argument is academic considering the wide array of innovative products that have come from, or been popularized, by the MLM industry. For example, no one even heard of Mangosteen, Noni, Goji or Acai ten years ago. Today these "super fruits" make up a billion dollar world wide market, both within and outside of the MLM industry. Yes, some marketers of these fruit drinks do over-hype their products, and many untrained, unprofessional distributors do make unsubstantiated claims about them. But let's be clear in that this is an issue with how MLM is often packaged, not with the content.



Yet, you go on to claim that an upfront requirement to purchase marketing and training material (which is typically less than $50) that will better educate the new rep on how to properly promote their business is an "unnecessary and are inappropriate" red flag.



You go on to site online material such as Van Druff's “What's Wrong With Multi-Level Marketing?” as a credible source of information. This is in spite of the fact this article was originally written 21 years ago by an individual who has never participated in the profession he criticizes. This is one of the most ill-conceived and debunked anti-MLM article in existence, as is evident here: http://www.marketwaveinc.com/viewarticle.asp?id=7



Your suggestion to look for a formal home office street address is valid, however the existence of a toll-free number is virtually meaningless considering the ease in which one can now be obtained, and considering Bernard L. Madoff Investment Securities LLC had one. Furthermore, the BBB routinely issues low grades to MLM companies due to the "industry in which this business operates" – that is, until the company pays for BBB membership. Then the BBB will have no concern about the "industry in which this business operates" and will unconditionally award it at least an "A-" grade.



While I agree with your "red flags" #2, #3, and #4, when evaluating whether more income is coming from purchases of downline reps, per #5, you must also consider that, according to several states as well as the Federal Trade Commission, those downline reps can count as bona fide customers. As can be gleaned from this FTC letter to the DSA here, http://www.marketwaveinc.com/FTC_Letter.pdf, the FTC considers only the motive for buying the product, not what percentage is sold to non-distributor customers. And, in fact, many retail customers do choose to become reps, and most MLM reps are passionate, often to a fault, about their products.



You state, "you will need lots of family and friends to make it work" yet just a few sentences later you state "The Internet has made it so easy now. In the old days you had to actually visit people, or at least call them, to pitch your fabulous new opportunity." Your first statement is utterly false, while your latter statement is quite correct. While exposing one's product or opportunity to a friend or family member is still common (with the majority of industry leaders training to lead with the product), the majority of marketing is now done online and directed towards one's "cold market".



You further theorize that "Multi-Level Marketing” and “Network Marketing” were "sanitized terms" invented after Amway and others were charged with “pyramiding” back in the early 1970s. What you failed to mention was that the courts ultimately ruled Amway, and thus the MLM compensation model, was NOT an illegal pyramid. Furthermore, the term “Network Marketing” was coined in the early 1990s.



Finally, you do concede "there must be something to the business model" since "some big business icons like Donald Trump are joining in the MLM parade". Besides Trump you can include the afore-mentioned Warren Buffet, as well as Anthony Robbins, Robert Kiyosaki, Paul Zane Pilzer, Brian Tracy, Mark Victor Hansen, and Bill Clinton (http://www.youtube.com/DirectSelling411) as supporters of this profession.



Martin, pyramid schemes do often try to disguise themselves as legal, legitimate MLM operations – because they want to be perceived as legal and legitimate. And yes, we do suffer a guilt by association with illegal pyramid schemes, but this is due precisely to wholly inaccurate portrayals within the media such as yours.

California’s SB 1411, which adds a layer of criminal and civil penalties for certain online impersonations, goes into effect starting today. The consequences include a fine of up to $1,000, and/ or up to a year in jail. So don’t go and do something crazy like impersonate Google CEO Eric Schmidt on Facebook. There may be consequences.


The full text and a summary of the bill are below. There’s a good overview and analysis of it as well, on ZDNet. The state has created a new crime, and a new section is being added to the penal code.


There has to be intent to harm, intimidate, threaten, or defraud another person – not necessarily the person you are impersonating. Free speech issues, including satire and parody, aren’t addressed in the text of the bill. The courts will likely sort it out. Hopefully without my direct participation.


SB 1411, Simitian. Impersonation: Internet.

Existing law makes it a crime to falsely impersonate another in

either his or her private or official capacity, as specified.

Existing law also makes it a crime to knowingly access and, without

permission, alter, damage, delete, destroy, or otherwise use any

data, computer, computer system, or computer network in order to

devise or execute any scheme or artifice to defraud, deceive, or

extort, or wrongfully control or obtain money, property, or data. For

a violation thereof, in addition to specified criminal penalties,

existing law authorizes an aggrieved party to bring a civil action

against the violator, as specified.

This bill would provide that any person who knowingly and without

consent credibly impersonates another actual person through or on an

Internet Web site or by other electronic means, as specified, for

purposes of harming, intimidating, threatening, or defrauding another

person is guilty of a misdemeanor. The bill would, in addition to

the specified criminal penalties, authorize a person who suffers

damage or loss to bring a civil action against any person who

violates that provision, as specified. Because the bill would create

a new crime, the bill would impose a state-mandated local program.

The California Constitution requires the state to reimburse local

agencies and school districts for certain costs mandated by the

state. Statutory provisions establish procedures for making that

reimbursement.

This bill would provide that no reimbursement is required by this

act for a specified reason.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:


SECTION 1. Section 528.5 is added to the Penal Code, to read:

528.5. (a) Notwithstanding any other provision of law, any person

who knowingly and without consent credibly impersonates another

actual person through or on an Internet Web site or by other

electronic means for purposes of harming, intimidating, threatening,

or defrauding another person is guilty of a public offense punishable

pursuant to subdivision (d).

(b) For purposes of this section, an impersonation is credible if

another person would reasonably believe, or did reasonably believe,

that the defendant was or is the person who was impersonated.

(c) For purposes of this section, “electronic means” shall include

opening an e-mail account or an account or profile on a social

networking Internet Web site in another person’s name.

(d) A violation of subdivision (a) is punishable by a fine not

exceeding one thousand dollars ($1,000), or by imprisonment in a

county jail not exceeding one year, or by both that fine and

imprisonment.

(e) In addition to any other civil remedy available, a person who

suffers damage or loss by reason of a violation of subdivision (a)

may bring a civil action against the violator for compensatory

damages and injunctive relief or other equitable relief pursuant to

paragraphs (1), (2), (4), and (5) of subdivision (e) and subdivision

(g) of Section 502.

(f) This section shall not preclude prosecution under any other

law.

SEC. 2. No reimbursement is required by this act pursuant to

Section 6 of Article XIII B of the California Constitution because

the only costs that may be incurred by a local agency or school

district will be incurred because this act creates a new crime or

infraction, eliminates a crime or infraction, or changes the penalty

for a crime or infraction, within the meaning of Section 17556 of the

Government Code, or changes the definition of a crime within the

meaning of Section 6 of Article XIII B of the California

Constitution.

Making Internet Money

well i don't have much thought provoking opinion in regards to any of those 5 subjects. except Øbomba is a liar and has no balls. now i am very confused what to think about JA. i just read a long article this morning on NYT about the accusations these swedish woman made in regards to him and having sex with him. i think they sound like tiger's dumb doo girls. they wanted it so bad from this julian man, probably secretly wanted to get pregnant. then twist the whole story and condemn him. i am just sick of all this shit being news anyway.


yeah, let's just all be really merry around here like WB7 is every day. winky faces galore and so happy holidays. jeeze get real, it ain't so happy for 99% of people on this earth. why are you pretending to be so above this blight of criminals, destroying every piece of earth, wildlife, ocean beings and people's lives and future, happy holly dazing. america showing all this fake shit like lights and cutting down evergreen trees and putting stupid fake ornaments and lights in each window. it is a BIG waste of energy, that gets EXCEL energy wealthy and those MOFO ceo's billions. christ someone here in boulder put up a HUGE light bulb star on flagstaff mt. it looks hideous. stars don't look like this, nor made of fake stupid incandescent light bulbs.

Fishing for compliments is something of a misdemeanor in most social circles — unless your circle is the Internet and you’re fishing with a shiny, new vanity app.

ThreeWords.me is making the rounds this week. It’s a simple app that lets you solicit three-word responses from your friends around the web. Each respondent simply goes to your unique ThreeWords.me URL and enters three words about you.

Your friends can also add comments along with their three words, and you can reply to any entries. In your dashboard, you can see which words people entered the most.

You might get a lot of complimentary words, but be warned, o ye of little self-confidence: The app allows for anonymous commenting, so steel yourself for trolls, profanity and put-downs. You can delete any of the entries at your discretion. You can also choose to make all your responses private.

The premise is ever so grade school, which adds to the app’s charm. While ThreeWords.me is without question a slightly narcissistic game aimed squarely at the perpetually insecure social media scene, it’s nevertheless cute and catching on like wildfire through class='blippr-nobr'>Twitterclass="blippr-nobr">Twitter and class='blippr-nobr'>Facebookclass="blippr-nobr">Facebook.

Its UI is simple, as well. You get to upload a background image and profile photo; other than that, the pages are decidedly bare-bones and lacking in the design department. Then again, the design isn’t what matters about this app; getting people to talk about — and hopefully compliment — you is what drives traffic to the pages in this case.

You can connect the app to Facebook, but sadly, you can’t use Facebook or Twitter to find your friends who are also using the app. You’ll have to do that part manually, a major shortcoming that’s likely holding the app back quite a bit in terms of adoption and growth.

ThreeWords.me puts us in mind of Formspringclass="blippr-nobr">FormSpring, Facto and a slew of other vanity apps we’ve been watching lately.

The app was created by college freshman Mark Bao, a teenager who’s been trying his hand at web-based entrepreneurialism for quite some time already. While we don’t see ThreeWords.me as a money-making endeavor right now, we’re sure the exposure can’t hurt.

Making Money on Line


Ross Douthat is right to say that worrying about what would happen if Ron Paul seized ultimate power and decreed America a minarchy probably isn't a good use of anyone's time. But where Douthat thinks that minarchy is used as a way to dismiss libertarians, in practice, I've tended to find it their first line of defense -- the right's version of "well, Marxism has never really been tried."



To some degree, you see it in Douthat's post, when he quotes Conor Friedersdorf lamenting "that libertarians hold very little power in this country." The reality is that the sort of incremental libertarianism that aligns with the interests of rich individuals and corporations has quite a lot of sway in Washington, but it routinely manages to escape the consequences of its ideas because, libertarians argue, the world we live in isn't the world they would've built, and so how can they be asked to answer for it? It's the "don't blame me. I voted for minarchy" defense.



But if the argument is that incremental libertarianism deserves more respect, then it also deserves more accountability. Desperate storytelling about Fannie Mae and Freddie Mac aside, the financial crisis was, in large part, the product of the idea that massive financial markets that we didn't understand would effectively regulate themselves. Alan Greenspan, perhaps the only man in America with the unilateral power to have prevented the blowup, has been quite clear on the flaw in his thinking: "Those of us who have looked to the self-interest of lending institutions to protect shareholder's equity — myself especially — are in a state of shocked disbelief."



To a first approximation, that was a failure of not just a crucial pillar of libertarian economic thought, but of libertarian practice: We spent the '90s not just deregulating, but much more dangerously, refusing to enact new regulations even as the financial system changed dramatically. One of the key players there was Sen. Phil Gramm, who certainly has his fans at the Cato Institute. His was the sort of libertarianism that is politically potent because it is backed by lots of money and lots of elites who combine to push it into the public discourse.

Taxes are another example. Plenty of libertarians have lined up for repeated tax cuts under the theory that they would stoke enough growth, and force enough compensatory budget cutting, to put the country on a more sustainable fiscal path. Plenty of wealthy individuals and firms have pumped a lot of money into propagating that theory and rewarding politicians who vote they way it asks them to. That theory, however, has been a disaster as a policy matter, even as the individuals and firms have made a lot of money.



And there's a lot of power, of course, lined up against anything that gets us close to single-payer health care. Most of the arguments made in that debate are fundamentally libertarian ones: that it will reduce freedom, or that government programs are inevitably bloated and wasteful ("Like going to the DMV? You'll love government health care!"). Cato's policy wonks spent much of 2009 on television arguing against reforms that would mean more government intrusion into the marketplace. Politicians and political organizations, meanwhile, received a lot of money and support in exchange for making those arguments. But it's of course true that America, being the developed country with the least nationalized health-care system, also spends the most and has the highest rate of uninsurance.



So when Douthat says that "a more-empowered libertarianism could have a salutary impact on debates over, say, the future of the entitlement system," it's worth asking what impact semi-empowered libertarianism has already had on debates over the entitlement system. That libertarian dreams of a privatized (or completely dismantled) Medicare system haven't come to pass is no more relevant than dreams of minarchy. What has come to pass is an aggressive and successful effort to stop America from following other countries' paths to national health-care systems. And the result can be seen here: If our costs had followed their costs, we'd have no budget deficit to speak of. Libertarians shouldn't have to answer for minarchy. But they do have to answer for that.




Weekly Pulse: GOP Plays Chicken with the Debt Ceiling

Sen. Jim DeMint (R-SC) is calling for a "big showdown" over the upcoming vote to raise the nation's debt ceiling to $14.3 trillion from $13.9 trillion. The debt ceiling is simply the maximum amount the government can borrow.

Congress routinely raises the debt ceiling every year. It's common sense: Since the government has already pledged to increase spending, Congress must authorize additional borrowing. (Remember that the government is now forced to borrow billions of extra dollars to pay for tax cuts for the wealthy, which Republicans insisted on.) If the ceiling isn't raised, the United States will be forced to default on its debts, with catastrophic consequences.

Why would default be catastrophic? The principle is the same for countries and consumers alike: If you have a good track record of paying your bills, lenders will lend you money at lower interest rates. If you don't pay your bills on time, or default on your obligations altogether, lenders will demand higher interest rates.

Congressional Republicans say they oppose raising the debt ceiling because they favor fiscal responsibility. This kind of rhetoric is the height of recklessness. The interest on our debts is a big part of government spending. Even idle talk about defaults could spook some creditors into raising interest rates on U.S. debt and cost taxpayers dearly.

Steve Benen of the Washington Monthly quotes Austan Goolsbee, chair of the White House's Council of Economic Advisers, who says that congressional GOP members are flirting with the "the first default in history caused purely by insanity."

Making work pay (for real)

An astonishing 80% of full-time minimum wage workers can't afford the necessities of life, according to new research by labor economist Jeannette Wicks-Lim of the Political Economy Research Institute, featured on the Real News Network.

Wicks-Lim argues for a two-part solution to the crisis of working poverty in America: i) raising the federal minimum wage to $12.30/hr from $7.50/hr; ii) Increasing the earned income tax credit to 40% of income. She estimates that these two policy changes would raise the income of a minimum wage worker from $15,000 to about $36,000 at a manageable cost to employers and taxpayers.

Her proposal is a revamp of President Bill Clinton's attempt to "reform" welfare by cutting social service benefits and shifting government spending to tax credits. Currently, the Earned Income Tax Credit is a subsidy for the working poor that is designed to "make work pay"--i.e., if workers aren't making enough in wages to secure a decent standard of living, the government provides an income subsidy to reward them for working.

However, if a decent standard of living remains out of reach for 80% of full-time minimum wage workers, Wicks-Lim argues that the minimum wage is too low and the subsidies are too modest to achieve the stated goal of making work pay.

Colorado minimum wage inches up

Speaking of minimum wage issues, Scot Kersgaard of the Colorado Independent reports that the minimum wage in the state ticked up from $7.25 an hour to $7.36 on January 1. The modest increase represents the annual adjustment for inflation. Every bit counts, but Colorado families are falling further behind. According to a new report by the Denver-based Bell Policy Center, 8.3% of working families in Colorado live below the federal poverty line, which is $22,050 for a family of four. Fully one-fourth of Colorado families do not earn enough to meet their basic needs, which requires an income approximately twice the FPL, according to the report.

Colorado is one of only 10 states that automatically adjust their minimum wages for inflation.

Wage theft epidemic

Unscrupulous employers are stealing untold millions of dollars from hardworking Americans, Dick Meister reports in AlterNet:

The cheating bosses don't take the money directly from their employees. No, nothing as obvious as that. The employers practice their thievery by underpaying workers, sometimes by paying them less than the legal minimum wage. Or they fail to pay employees extra for overtime work, or even force them to work for nothing before or after their regular work shifts or at other times. Some employers make illegal deductions from employee wages. And some withhold the final paycheck due employees who quit.

In New York City alone, an estimated $18 million worth of wages is stolen every week. Workers in the restaurant, construction, and retail sectors are at increased risk of wage theft. Wage thieves disproportionately target undocumented workers because they assume that these employees will be less likely to report the crime.

Debt collection from beyond the grave

The dead don't tell tales, but they have been known to sign debt collection papers, Andy Kroll reports in Mother Jones. Martha Kunkle died in 1995, but her printed name and signature appear on paperwork filed by the debt collection agency Portfolio Recovery Associates as late as 2006 and 2007. The ruse was discovered and PRA, facing a fraud lawsuit, agreed in 2008 that the "Kunkle's" documents couldn't be used in court. That didn't stop the agency from trying to use them again in 2009.

The attorney general of Missouri has announced that he will investigate whether any of Kunkle's handiwork was used to support debt collection in his state. The attorney general of Minnesota is already investigating whether debt collectors have used fraudulent paperwork in court.
