Well, yes, let’s think about the cost of paying rent for five or more years. In fact, let’s plug all our numbers into a rent-vs-buy calculator and see where we’re at after five years. The problem with Linda’s formulation here is that it helps to reinforce the common fallacy that 100% of rent payments are “wasted,” in a way that mortgage payments are not. But that’s simply not true. In both cases you’re paying money every month for your shelter; in the rental case that money goes to the landlord, while in the ownership case it goes to the bank.


Some small part of your monthly payment may or may not end up helping you build equity in your home, if house prices move up rather than down and depending on how much of your payment goes towards principal. But remember that the alternative here is saving up for a down payment — which is essentially the same thing as building up equity in a future home. If you save up $250 per month for five years and then put down $15,000 as a down payment, then you immediately start off with $15,000 of equity in your home. By contrast, if you buy today with no money down and start making mortgage payments, there’s a good chance your equity will be much less than $15,000 in five years’ time.

Even if you have the money for a bigger down payment, there can be good reasons to save your cash. Mortgage rates continue to skirt all-time lows: Why not put your money to work for yourself and borrow as much as you can reasonably afford, on a monthly basis, at today’s rates? You can put the money you’re not paying into a down payment to work elsewhere. If home values rise, you will have done your best to leverage a small down payment into bigger equity. If they fall, you’ll have less skin in the game, and that could put more pressure on your banker to improve your loan terms lest you walk away.


This, in a nutshell, is everything that was wrong with the housing market before the crash — everything that we want to avoid going forward. Can’t Linda look around at the current devastated state of many people who bought with little or no money down, and see the dangers here? Evidently not. Instead, she seems to think it’s a bright idea to borrow more money than you need, to the point at which you’re pushing the envelope of what you can reasonably afford. And then take the cash you’re not using for a down payment, and “put your money to work for yourself.”


I barely know where to start on this. Here’s one way of thinking about it: banks are not charities, and that they expect to make money from their loans. They have a cost of funds which is lower than the mortgage rate that you’re paying; the difference between the two rates is their profit. You, however, if you follow Linda’s advice, have a cost of funds which is your mortgage rate: if you wind up getting a lower return on your savings than you’re paying on your mortgage, you would have been better off just using the money for a down payment. Needless to say, if there was an easy way of getting a higher return on capital than the mortgage rate, the banks would have done it already, rather than lending you the money. And it’s pretty delusional, frankly, to think that you can invest better than say JP Morgan. Yes, there are tax benefits to having lots of mortgage-interest payments. But they’re not sufficient to make the difference here.


Here’s another way: let’s say you own your home outright. Would you take out a mortgage against 95% of your home’s present market value, and then invest that money in the market somehow, trying to “put it to work for yourself “? Of course not: you don’t have remotely that kind of risk appetite. Borrowing money against your house to invest in the market is, always, stupid. But that’s exactly what Linda’s proposing you do.


And here’s one more: shit happens. Sometimes, you end up needing money, in an emergency. If you’re already borrowing as much as you can reasonably afford, that’s a big problem. If you have a bit of fiscal breathing room, you’re much better off. If you end up in a situation where you’re in a position to put pressure on your banker to improve your loan terms lest you walk away, that’s not a good situation to be in. It means you’re broke. It’s something you want to avoid, whereas in Linda World it seems to be something to actively court.


Linda’s also convinced that house prices are going to rise: if you buy now rather than later, she writes, that means you’re buying “while housing prices are low.” That’s debatable — they still seem quite expensive, on some measures: the price-to-rent ratio, for instance, is still well above its historical average. And more generally, buying low doesn’t help you in the slightest if prices just continue to grind lower.


Linda’s conclusion is that “the less you put down, the better off you are.” Which is true so long as you keep on making all your mortgage payments without any problem, and nothing goes very wrong either with your personal economic situation or with the US economy as a whole. That’s the way that leverage works: it makes everything sunny, so long as things go right. And then it plunges you into misery when things go wrong.


The scariest part of Linda’s post, for me, is when she talks about how it’s a good idea to “do your best to leverage a small down payment into bigger equity.” It’s not the dollar amount of the equity she’s talking about here, it’s the leverage used to get there, and the higher the leverage the better off you are. Following that advice got us into our current mess. And taking it now is a recipe for disaster.



That said, for the non-exact nature of figuring this out, if you don't want to wait for your fortune it probably comes as no surprise that technology is your best bet and is tied for the lowest average billionaire age (thanks, Facebook billionaires) with metal and mining. Salisbury wanted people to be able to blow off steam in-between sessions. The "V" was large enough to let a croquet ball pass. All of the #406 chairs have since been sold off or scrapped -- people got too caught up in the game and it became a distraction.



After multiple years of writing proposals to the U.S. mint, Salisbury finally hit the big time in 1965 with his Average Citizen Quarter Program (or ACQP). The idea was simple: put an average citizen on a quarter. For a year, applications were scoured over until Randy Young, a steelworker from Pittsburgh, was selected. The coins were minted in 1967. Less than two months after the coins were minted, Randy Young was arrested for armed robbery -- the coins became known as "Jailbird Quarters." The Mint immediately stopped production of the coins, and the ones that existed were given an acid treatment to hide their features and to shame both Salisbury and Young.



After the public disgrace of the Jailbird Quarters, Salisbury moved to New Jersey and began to write textbooks for elementary school students. The only one of his books that made it very far was Learn to Control Your Machine. The art on the cover was a drawing that Salisbury's uncle drew of Travis at age ten.



The text of the book was simply "Learn to control your machine" over and over again, much like in the movie The Shining. At least five times per page there was a spelling error, 500 errors in the book. Students were graded on the amount of errors that they could find. Salisbury made sure that there were at least 100 variations of the book so that the students couldn't cheat. Some students were actually helped by the book, others were scarred for much of their lives.



After finally making money with his book, Salisbury went back out west to Montana, and got his honorary Design Director position back. This was 1973. After noticing that many of the politicians were making embarrassing and even incriminating doodles in their notebooks, Salisbury made them a custom notebook that would solve the problem. They would have the usual-sized ruled paper, but there would be a bigger column left near the binding when they tore off pages. This notebook had an area for doodles and a doodle book that the politicians could keep for later once all of the pages had been ripped off. A doodle book from the Montana State Legislature recently sold on eBay for $1000.

This gives almost 50 million total first lien mortgages or about 6.4 million delinquent or in foreclosure.



From the MBA: Short-term Delinquencies Fall to Pre-Recession Levels, Loans in Foreclosure Tie All-Time Record

The delinquency rate for mortgage loans on one-to-four-unit residential properties decreased to a seasonally adjusted rate of 8.22 percent of all loans outstanding as of the end of the fourth quarter of 2010, a decrease of 91 basis points from the third quarter of 2010, and a decrease of 125 basis points from one year ago, according to the Mortgage Bankers Association's (MBA) National Delinquency Survey.

The foreclosure inventory rate captures loans from the point of the foreclosure referral to exit from the foreclosure process, either through a cure (perhaps through a modification), a short sale or deed in lieu, or through a foreclosure sale. As we predicted last quarter, the percentage of loans in the foreclosure process increased in the fourth quarter, largely due to the foreclosure paperwork issues that were being addressed in September and October. These issues caused a temporary halt in foreclosure sales, particularly in states with judicial foreclosure regimes, such as New Jersey, Florida, and Illinois. With fewer loans exiting the foreclosure process through sales, the foreclosure inventory rate naturally increased, even as fewer foreclosure starts meant that fewer loans entered the foreclosure process in the fourth quarter."
Yesterday it was announced that an enforcement action (and probable fines) against the mortgage servicers is imminent. As part of any agreement, I expect the servicers will be moving ahead with both more modifications - and also with more foreclosure sales - so the percent of loans in the foreclosure process might have peaked (or will peak in Q1 2011).

Fannie Mae reported that the serious delinquency rate decreased to 4.48% in December from 4.50% in November. This is down from 5.38% a year ago.



Freddie Mac reported that the serious delinquency rate decreased to 3.82% in January from 3.84% in December. (Note: Fannie reports a month behind Freddie). This is down from 4.15% in January 2010.



These are loans that are "three monthly payments or more past due or in foreclosure".

Some of the rapid increase in 2009 was probably because of foreclosure moratoriums, and also because loans in trial mods were considered delinquent until the modifications were made permanent. As modifications have become permanent, they are no longer counted as delinquent.



The slowdown in the decline was probably related to the new foreclosure moratoriums last year. Going forward, a key question is if falling house prices will lead to an increase in serious delinquent loans.

Making Money on Internet


Of all the smartphone makers whose names are not Apple, HTC is the most impressive. An upstart company from Taiwan, it has done a great job of building iconic hardware using commodity platforms. It has developed branding and messaging that’s edgy, cool and fun.


More importantly, it was the first company to embrace the idea of developing a user experience layer in order to differentiate itself from the commodity OS-based hardware devices that would flood the market. So, it came up with HTC Sense. A lot of credit for this unique sensibility should go to Horace Luke, HTC’s chief innovation officer, who has been the lightening rod behind the company’s design philosophy.


Perhaps that’s why I’m amazed he allowed HTC to release the abominations that are being called HTC’s Facebook phones. These are essentially nothing but regular HTC devices with a dedicated button for Facebook, which provides:


one-touch access to your friends and family. With a simple touch of the Facebook button, your network is immediately privy to the song you’re listening to, the new restaurant you’re checking out or interesting website you’ve stumbled upon.


These aren’t really Facebook phones, which are a whole different beast, and will be game changers when they come to market. If you want to know what a real Facebook Phone will look like – let’s just say it won’t be anything like HTC ChaCha or HTC Salsa. Kevin Tofel pointed out, “aside from the dedicated hardware button, many of the Facebook integrations are already available in widgets or natively in Android.” As I wrote earlier, a real Facebook phone will be a phone that embeds Facebook services in the very core of the phone and uses a Facebook user experience layer.


What these phones seem to be is a marketing gimmick cooked up by the marketing department at HTC and not the innovators. I can guarantee you Apple would never pull a cheesy move like this. Remember the long-forgotten days when Motorola introduced an iTunes phone? Well, we saw how that worked out.


This move by HTC reminds me of the late-90s, when the Internet mania was in full swing. Many companies were jostling for pole position and ended up paying a lot of money to PC makers to place their Internet access software or browser software on the desktop. Others went so far as to bake these Internet software/services into their devices via dedicated buttons. PC makers made those moves by sacrificing the needs of their primary customers and letting the greed get the better of them.


This time around, the situation is entirely different. Hardware makers are leveraging hot Internet brands to differentiate themselves and sell their increasingly commoditized hardware. By building a Facebook button, HTC is essentially trying to anoint Facebook as the social network of choice.


What happens if Facebook becomes less popular and something else pops up? Will HTC make a phone dedicated to that service? Will we soon see a Twitter button, an Angry Birds button, and a Bing button? Or all of them? Will HTC soon be selling hundreds of different models, each with dedicated button? If yes, how will they bring them to market?


The sad part is, now that HTC has gone ahead and done this, it’s almost a certainty that others are going to copy them and start rolling out phones with dedicated buttons. It won’t be good for the overall smartphone market.


The idea of dedicated buttons goes against the very design philosophy behind smartphone platforms. I believe smartphones are blank canvases meant to be hyper-personalized by average Joes and Janes, who download the apps they want and make the device fit their life. I am sorry, HTC; I don’t want you or anyone else making a choice for me via dedicated buttons.

If you’re like me, then you have a music library that’s ungainly and a tad unorganized. For some odd reason, many of the tunes you’ve gathered over the years have missing tags or cover art. I’m back. CPAC week came and went. Then another week came and went after the horrible cold I got at CPAC. But now I’m healthy again and it’s time to start catching up. Though there’s no way I’m going to post on every tidbit I’ve run across in the last two weeks, I can try to hit the highlights.


And let’s start with the fact that the Internet Kill Switch is back under a new name. Susan Collins and Joe Lieberman have reintroduced the bill under a new name. They think if they put freedom in the name that we’ll ignore the problems inherent in giving the President emergency powers to wage economic war on America. The Internet Kill Switch is a broken idea. We don’t let the President close supermarkets nationwide if one butcher in one city has an e. coli outbreak. We can’t apply the same overreaction online.



Also while I’ve been out of it, House Republicans have been busy. As I understand it, we’ve not only grilled the administration on the “Stimulus” spending on communications, but we’ve also passed an amendment to the continuing resolution in order to defund Net Neutrality. I love it. Our Energy and Commerce leadership in the House has so much going on, including Obamacare, but they seem to relish the opportunity to strike back so much and so hard at the administration’s illegal overreaching. From the cheap seats, Greg Walden, Fred Upton, and others are doing a great job.


Fun fact: when the House debated Net Neutrality defunding, the Democrats very strangely started making arguments that government should leave the Internet alone. Anna Eshoo said “I would not fool around with an open, accessible Internet.” Hey, for once we agree.


By the way, fun fact: Net Neutrality is so terrible for innovation and customer service that ISPs turned down ARRA money to try to stay away from it. Yes, they turned down free money from the government because regulation is just that costly.


Further, the Net Neutrality coalition continues to crumble. Collin Petersen, Democrat of Minnesota, flipped sides by voting for defunding NN after voting for NN last Congress. Perhaps he noticed the total wipeout in 2010 of PCCC candidates pledged to support Net Neutrality. Every single Democrat who signed the PCCC Net Neutrality pledge went on to lose in November.


Meanwhile, Julius Genachowski and the FCC still don’t get the message. He thinks he’s entitled to debate the Congress instead of taking orders. Greg Walden announced plans to pressure him on transparency, which should help teach him who’s boss, you’d think.


Though we have to give Genachowski credit on one thing: He admits the Netflix/Level 3/Comcast issue is not a violation of Net Neutrality.


Michael Copps, pet commissioner of neo-Marxists everywhere, deserves no credit though. He’s now pushing for more speech controls in the name of “disclosure.” It’s about control and gathering power in Washington.


The FCC still needs lots of oversight, though, as conflicts of interest continue to crop up, this time with an FCC official having PBS as an employer.


I have more to write on in the coming days on Google and Copyright, especially the Combating Online Infringement and Counterfeits Act (COICA) which threatens to continue the criminalization of copyright law in America and expands government online in the name of protecting a few big companies.
